Dave said that they are “very pleased for all the paging industry.”

We have been following and reporting on this legal battle for some time. It is really good to see this well-deserved victory in the courts. It will benefit many others as well. The whole history of the interconnected industry in the United States has been one of the “little guy” resisting attempts by the big telcos to unfairly restrict their activities through “red tape” and unreasonable pricing.

A new issue of The Wireless Messaging Newsletter gets posted on the web each week. A notification goes out by e-mail to subscribers on most Fridays around noon central US time. Since the attacks on 9/11, federal, state, and local governments have been focused on improving communications during a crisis situation. Communication problems before, during, and after hurricane Katrina underscored the need to make changes sooner rather than later. As a result, the FCC established the Hurricane Katrina Independent Panel to find out what worked, what did not, and what could be done to improve communications in a crisis situation.  AAPC President Bruce Deer’s testimony about the reliability of paging got the attention of the panel. The panel made several comments in its recommendations that included paging as a solution.

After testifying, President Deer established a task force to keep the momentum moving in our industry’s direction. One of the key duties of the task force was to create materials that AAPC members could use to make presentations about the merits of paging during a crisis situation to federal, state, and/or local emergency management agencies.   

By echoing the message delivered to the Katrina Panel at the state and local levels, we hope to raise the overall awareness about the reliability and successful history of paging in a crisis situation.  By doing this, we expect that paging will be recognized as a “must have” component of our Emergency Alerting System and as an adjunct to other communication systems in times of crisis. While we are certain that the widespread adoption of paging as a communication solution in a crisis situation will benefit our membership, we are just as certain it will benefit our first responders and the victims of a disaster.

Nighthawk Systems Receives Larger Order from El Paso Electric

SAN ANTONIO, TX – 10/10/06- Nighthawk Systems, Inc. (OTC BB: NIHK), a leading provider of intelligent wireless power control and emergency notification products, announced today that El Paso Electric has placed an additional, larger order for Nighthawk’s CEO700 remote power disconnect units, which will operate on the American Messaging wireless network. El Paso Electric has chosen to move forward with their ongoing remote disconnect program utilizing the Nighthawk Systems-American Messaging partnership.

Nighthawk’s CEO700 gives electric utilities the ability to remotely disconnect and reconnect power to residential electric meters, saving them significant time and money over the traditional manual disconnect method requiring field personnel. Last month, Nighthawk Systems and American Messaging announced they had strengthened their joint marketing agreement to take advantage of their core competencies and provide the best wireless remote control solutions possible to their customers.

REPORTS SAY xG GETTING READY FOR LONDON IPO: Florida-based xG Technology Inc. is getting ready for a $56.9 million IPO on the London stock exchange, according to RCR Wireless News. Although the company did not confirm that reports about its initial public offering plans, there is speculation that xG is demonstrating its wireless Voice over Internet Protocol (VoIP) technology called xMax to investors and expects to be listed in early November. In mid-July, according to RCR Wireless News, xG announced it was considering applications from parties interested in operating its technology, with the first systems expected to be up and running in the first quarter of 2007. Using single-cycle modulation to deliver longer range and lower power RF communications, xG said its patented xMax base-station technology works in the 900 MHz band but is also suited to work within other bands. xMax is designed to deliver three times the range of other wireless technologies with comparable power and antenna height (BloostonLaw Telecom Update, July 19). The company said its proprietary modulation method differs from conventional approaches where tens to hundreds of thousands of RF cycles are required to convey a single bit of information. With each additional cycle representing more RF power, the company says its technology reduces the amount of cycles, and thus power, needed to transmit signals. The result is power-efficient RF transmission, which is important for battery-operated mobile devices. RCR noted that Chris Whitely, vice president of communications at xG, said the company’s strategy includes “regional Internet service providers, CLECs, local communications carriers and entrepreneurs that can operate xMax networks within exclusive territories.” In late March, privately held xG announced that its first consumer product, a VoIP handset, would be available by the end of this year and that the device would work with low-cost xMax-enabled base stations. The handsets are expected to be dual-mode, equipped with both xMax and Wi-Fi chips, enabling users to roam into areas not covered by the xMax network of base stations. In addition, xG said the handsets would include Ethernet jacks so that users can plug into data networks for fixed-line VoIP calling, RCR said. The company held its first public demonstration of xMax technology for media and investors in November in Fort Lauderdale, Fla. In that demonstration, an xMax-equipped transmitter broadcast a 3.67 megabit-per-second signal more than 18 miles using only 35 milliwatts of RF output power. In February, xG hired the London office of Credit Suisse as a strategic adviser for the company's technology launch. PARSIPPANY, N.J., Sept. 29 /PRNewswire-FirstCall/ — Aquis Communications Group, Inc. The EA1 is the solution for remotely activating public warning signage.  Examples include tornado sirens, flash flood warnings, fire danger, Amber Alert, icy roads, etc.  The EA1 can also send text messages to scrolling signs.  This can occur in conjunction with the activation of audible alarms and visual strobes.  This is ideal for public notification in buildings, schools, hotels, factories, etc. The group call feature allows for any number of signs or flashing lights to be activated at the same time over a wide geographic area.  In addition, the EA1 Emergency Alert is the perfect solution for low cost yet highly effective alerting of volunteer fire fighters in their home.  When activated the EA1 will emit an audible alarm and activate the power outlet on the units faceplate.  A common setup is to simply place the EA1 on a table and plug a lamp into the faceplate.  When paged from dispatch or any touch tone phone the EA1 will awaken the fire fighter to a lit room.  As an option the EA1 can be ordered with a serial cable, allowing for attachment of a serial printer.  When paged the alphanumeric message will be printed out at the same time the alarm sounds and the outlet is activated.  The EA1 is an ideal complement to alphanumeric belt pagers common to volunteers.

Firehouse Automation

The FAS-8 is designed for activating one or more relays in a firehouse and if desired, printing the alphanumeric message to a serial printer.  For this application the FAS-8 is set to activate upon receiving the proper paging cap code sent from 911 dispatch.  Up to eight different devices can be activated all with individual time functions.  The most common devices to turn on include the PA amplifier, audible wake up alarm, and house lights.  The most common device turned off is the stove.  The FAS-8 can accept up to 8 different cap codes and have separate relay and time functions per cap code.  This allows for different alerting to be accomplished at the same physical location depending upon which cap code is sent.  This can be very helpful when fire crews and medical crews are housed in the same building.

BPL Orders Exceed FCC's Jurisdiction and Authority, League Court Filing Says

NEWINGTON, CT, Oct 12, 2006 — The ARRL this week notified the US District Court of Appeals — DC Circuit that it's appealing certain aspects of the FCC's Part 15 rules governing broadband over power line (BPL) systems. The ARRL Executive Committee ratified plans to go forward with the Petition for Review when it met October 7. The League is asking the court to review the FCC's October 2004 Report and Order (R&O) establishing Part 15 rules to govern BPL systems as well as its August 2006 Memorandum Opinion and Order (MO&O) that dealt with various petitions for reconsideration of the 2004 R&O, including one from the ARRL.

"ARRL seeks review of the orders on the ground that they exceed the Commission's jurisdiction and authority; are contrary to the Communications Act of 1934; and are arbitrary, capricious, an abuse of discretion, and otherwise not in accordance with law," the League said in its petition. "ARRL requests that this court hold unlawful, vacate, enjoin and set aside the orders."

A court filing that details the League's specific objections regarding the two orders is pending. Although the petition will argue a number of points, two specific aspects of the FCC's BPL orders precipitated the League's appeal. One is a new rule, only revealed after the FCC made the MO&O public, that limits the extent to which an unlicensed, unintentional radiator must protect a licensed mobile station.

The new rule, §15.611(c)(1)(iii), provides that BPL operators only have to reduce emission levels below established FCC permissible limits by 20 dB below 30 MHz and by 10 dB above 30 MHz -- even if that's not enough to resolve harmful interference complaints. The FCC called these levels "modestly above the noise level."

ARRL CEO David Sumner, K1ZZ, contends the rule change in the MO&O regarding mobile stations contravenes the International Radio Regulations and the Communications Act of 1934. "The FCC has, in effect, tried to redefine harmful interference," he said. "It can't do that. The Commission doesn't have the authority to do that, and we're going to demonstrate that to the Court of Appeals."

ARRL Laboratory Manager Ed Hare, W1RFI, has said the levels applicable to mobiles would be some 25 dB higher than the median values for man-made noise in residential areas and up to 40 dB higher than the minimum values hams use for reliable communication.

The Commission also declined to adjust the 40 dB per decade "extrapolation factor" applied to measurements performed at distances from power lines other than those specified in Part 15. Sumner says this is an important technical point because the existing Part 15 rule underestimates actual field strength.

In their petitions for reconsideration, the ARRL and others demonstrated that the 40 dB per decade extrapolation factor was wrong and that a figure closer to 20 dB per decade was appropriate. Sumner called the Commission's stand on the 40 dB per decade rule "clearly, demonstrably and inarguably wrong."

Sumner said the League decided to go forward with its appeal only after considering the effect on licensed spectrum users of letting the BPL rules stand. He addressed a number of ARRL's concerns with the FCC's BPL rules in his "It Seems to Us . . ." editorial in October QST.

Dear Mr. Schofield,

In the context of “paging” the common American usage of the term “alarming” is generally limited to situations where an automated device is monitoring some parameter on a home or business security system. As such, an “alarm” would be an indication sent directly to a pager (without human intervention) that a smoke detector has been triggered, or a door has been opened when it shouldn't have been, or a window has been broken. These are security alarms. This is a relatively uncommon usage in paging.

The term “alerting” is the more common one, referring to all other types of paging — like the action of one person communicating with another via a pager and alerting them to an action that needs to be taken.
