Dear Friends of Wireless Messaging,

I really had a great time at the Global Paging Convention — held June 16-18 in Charleston, South Carolina. I was able to see many old friends and to make some new ones too.

There were more than 120 people from 11 different countries.

One new friend is Nick Forlidas, Sr. Director Tech Operations SE for Aquis Communications. Nick and his charming wife Jade, rescued me one night from having dinner alone. We found a lot in common to talk about. Nick gave me some literature about the Aquis UnityAlert™ system. They are having considerable success with these alerting products and I will be giving a more detailed review of them in a future issue.

Well, it wasn't a perfect trip. One connecting flight was late so I had to spend and extra night at the Atlanta airport. No big deal. Stuff happens.

Congratulations to: Dr. Dietmar Gollnick of e*Message in Germany with the first annual Industry Service Award for his years of dedicated service, innovation, and significant contributions which have advanced the paging industry.

Please don't miss my "thoughts for the week." I focus on the presentation given by David Cartee of MedStarOne Ambulance Service. He highlighted an issue that I have been promoting for years. What kind of communication works during a major crisis?

In my fifty-plus years in radio communications, I have had to sit through many boring presentations. That was certainly not the case here. The presentations were all very good. This was like taking a graduate course on the paging business.

Anyone who got left out of this report should not think there was any hidden agenda or that there was any "malice aforethought." I did the best I could.

One more thing and I will get out of the way so you can see all the photos. I committed a major goof-up. I was so interested in talking to the guys at the Hark Technologies table, that I forgot to take their picture. You will find photos of just about all of those who advertise in this newsletter, except them. Shame on me. I would blame it on old age, but I was forgetful when I was young. So please check out their USB Paging Encoder, and their Paging Data Receiver.

Global Paging Convention — A Great Success!

WILMINGTON, N.C.—(BUSINESS WIRE)—The American Association of Paging Carriers (AAPC) and the European Mobile Messaging Association (EMMA) co-hosted their second Global Paging Convention in Charleston, South Carolina. Carriers, manufacturers, suppliers, and resellers from twelve countries, and five continents, joined together for two days to showcase their emerging technologies and applications, and to learn innovative approaches for wireless messaging from numerous educational sessions. The convention contributes to the success of the global paging industry by providing a forum for wireless companies to meet the challenges of the global environment with enhanced services and equipment.

Keynote speakers Peter Bryant from Swedish Medical Center based in Washington, and Craig Luze from Alegent Health based in Nebraska, reviewed the numerous ways that their respective medical facilities utilize paging technologies to communicate critical messaging to their staff. In addition, first responder, David Cartee of MedStarOne Ambulance Service reinforced the benefits of paging in major disasters, including its reliability, efficient and expedient one-to-many broadcast capability, extensive deployment, cost, and its simplicity. Other sessions focused on how to successfully capitalize on the strengths of paging technologies in other wireless communication markets and products today. Although not commonly known, paging technology has the ability to reliably broadcast a common message to everyone in a very large city, or an entire country, in the time it takes to make one telephone call. Manufacturers from several countries displayed their products and shared ideas for creative enhancements in the future.

Both associations awarded Dr. Dietmar Gollnick of e*Message in Germany with the first annual Industry Service Award for his years of dedicated service, innovation, and significant contributions which have advanced the paging industry.

AAPC is the trade association in the United States dedicated to representing and advancing the paging industry. Members of the association are primarily paging carriers and vendors that range from small businesses that are owner/operator service providers to large nationwide carriers. EMMA has similar goals and provides an international forum for related companies involved in wireless messaging.

Supreme Court Privacy Ruling Creates Precedent Speculation

A recent U.S. Supreme Court decision upholding the right of a municipality to examine the text messages of a public employee has created speculation that the ruling could set a precedent for private employers or others.

In the City of Ontario v. Quon, the court unanimously upheld the right of Ontario, Calif. to examine the personal texts of a city police officer, Jeff Quon, on his city-provided pager. In this case, the city was examining the messages because it was considering increasing the amount employees could send.

Police department officials found some inappropriate texts sent by Quon, who sued Ontario and said the search of his texts was a violation of the Fourth Amendment.

The ruling was specific to government employees who use government equipment and who have been warned they could not expect privacy, but Jack McCalmon, of the Tulsa, Okla.-based risk management firm McCalmon Group, said the case could create questions for employers in the private sector. Employers, he said, may begin to cite the case.

“There is still a void there because the court intentionally did not make itself clear,” Mr. McCalmon said. “It wasn't going to use this case to address privacy issues everywhere but someone will need to soon.”

This issue—the impact of technology on employees and employers—is moving fast, Mr. McCalmon said.

“Here [Mr. Quon] was warned that his emails could be read, but he didn’t think that applied to his texts,” Mr. McCalmon said. “Now you can equate the two...on the public level.”

The Supreme Court ruling overturned the U.S. Court of Appeals for the Ninth Circuit, which upheld an earlier ruling that Mr. Quon’s rights were violated.

Justice Antonin Scalia said the court did not need to address whether its ruling applied in general to employees with employer-issued pagers because the city’s search of Mr. Quon’s texts did not violate the Fourth Amendment in the first place. Yet the court brought up the subject without stating its stance, something Justice Scalia found “indefensible.”

“The-times-they-are-a-changin’ is a feeble excuse for disregard of duty,” he wrote. Justice Scalia said he worries lower courts will read into the decision as a “heavy-handed hint about how they should proceed.”

Mr. McCalmon said government employees should get a private phone for private texts.

Right to privacy vs. accountability

The Supreme Court ruled last week that the city of Ontario did not violate a former police officer's right to privacy by reviewing text messages on his government-issued pager.


The case derives from a 2003 lawsuit in which a police officer sued the city, claiming city officials had no right to review personal communications between himself and other city employees, one of whom was his wife.

It seems the officer was one of 20 employees who was issued a two-way pager in 2001. The device allowed employees to send and receive text messages.

While text messages are a pretty standard form of communication these days, it was a novel concept back then.

Some city employees sent a lot of text messages — so many, in fact, that they exceeded their limit and incurred additional charges from the service provider.

Anyone who has ever received an unexpectedly high phone bill due to a family member (usually a child, but sometimes a spouse) having suddenly discovered the joy of text messaging can probably relate.

When this happened in Ontario, back in 2002, the city conducted an investigation to determine just how these text-messaging pagers were being used. As it turned out, employees were sending personal messages to one another with the devices, and some of those messages were even a little saucy.

City officials were not happy, and a few officers were disciplined over inappropriate communications.

The officers sued the city in 2003, alleging the city had violated their civil rights.

A district court judge ruled against the officer and was overturned by the 9th Circuit Court of Appeal in 2008. Now, the Supreme Court has overturned the 9th, ruling that the city was within its rights to inspect the messages.

The case marks an interesting intersection of privacy and accountability.

It's disconcerting to think that your communications may be monitored by your bosses, the government, Big Brother or whomever.

However, most folks who use corporate e-mail accounts are aware that their companies reserve the right to review any e-mail sent on corporate servers.

Such was the case in Ontario, where pager recipients were told that communications on the devices were not necessarily private.

They apparently were also told, informally, that they were allowed to exchange personal messages provided they paid out of pocket for any charges incurred for exceeding the message limit, which is exactly what at least one of the officers who ended up suing the city did.

Bring on the lawyers.

As the case made its way through the system, headed inexorably for the highest of high courts, there was some anxiety and anticipation that the Supreme Court would set precedent on employees' right to privacy by limiting (or not limiting) employers' ability to review the electronic activities of their employees.

The court did not do that, though, instead issuing a narrow ruling on this specific case.

That's probably for the best, because in fact, this particular case is not simply employee vs. employer. This case is about public employees using taxpayer-funded pagers.

While the legal challenge sought a determination on whether city administrators had a right to review the communications of city employees, such a decision would also affect, collaterally, what access the public has to the communications of public employees in general.

I'm not suggesting here that the taxpayers should be reviewing the electronic communications of all public employees, because by and large, such communications are probably innocuous — even if they're a bit racy now and again.

But the right of access is important, and in some cases, vital to effective oversight and public accountability, especially for elected officials.

In this case, the court ruled that the city did have a right to review the messages, which seems appropriate and does not encroach on the public's access to government.

But what if the Supreme Court had instead affirmed the 9th Circuit Court's decision? While some would doubtless have touted such a call as a victory for privacy of the individual, would it have come at the expense of the public?

FTC Extends Enforcement Deadline For Identity Theft “Red Flag” Rule:
At the request of several Members of Congress, the Federal Trade Commission is further delaying enforcement of the “Red Flag” Rule through December 31, 2010, while Congress considers legislation that would affect the scope of entities covered by the Rule [the June 2010 monthly Private User Update inadvertently omitted this updated information].

Under the new rules, all businesses that maintain a creditor-debtor relationship with customers, including virtually all telecommunications carriers (but other companies as well), must adopt written procedures designed to detect the relevant warning signs of identity theft, and implement an appropriate response.

The Red Flag compliance program was in place as of Nov. 1, 2008. But the FTC will not enforce the rules until June 1, 2010, meaning only that a business will not be subject to enforcement action by the FTC if it delays implementing the program until June 1. The FTC announcement does not affect other federal agencies’ enforcement of the original Nov. 1, 2008, compliance deadline for institutions subject to their oversight.

Other liabilities may be incurred if a violation occurs in the meantime. The requirements are not just binding on telcos and wireless carriers that are serving the public on a common carrier basis. They also apply to any “creditor” (which includes entities that defer payment for goods or services) that has “covered accounts” (accounts used mostly for personal, family or household purposes).

This also may affect private user clients, as well as many telecom carriers’ non-regulated affiliates and subsidiaries. A Good Example For Our Daughters

You can be a smart, beautiful, and successful woman in what they used to call “a man's world” — like Nancy Andersen, who is the president of Teletouch Paging. I am sure Nancy would prefer a description of “interesting” or “energetic” instead of “beautiful” but I am sticking to my opinion; she is all of these.

Of course there are several other successful women in paging who are in this same category — good role models for our daughters — like Ann Phillips, Perri McNaught, and others. How about some reader comments on this? The guys can't get all the glory.

I have three daughters, and I always wanted them to have the same opportunities as men do. Success should be based on effort, dedication, integrity, intelligence, and knowledge of the job, not on gender, race, color, or appearance.

Comparing the Global Paging Convention to a baseball game — David Cartee of MedStarOne Ambulance Service hit a home run.

He "got it" from experience — that almost all large-shared communications systems are completely useless during a major disaster.

We all walk around with a false sense of security about those cell phones in our pockets. They work very well just about any time and any place. The same is true about first responders and their fancy new two-way radio systems. The truth is, none of this equipment will work when we need it the most! It's like having fire extinguishers hanging on the walls, all over a big building, but the extinguishers are all empty, and no one will know until the building catches on fire.

When disaster strikes and everyone tries to use their device at the same time, they won't work—they can't. Guaranteed.
